Teleheatlh Consultations:
Nature of Teleheath Consults: during the Telehealth consultations:
Details of your medical history, examinations, x-rays, and tests will be discussed with other health care professionals through the use of interactive video, audio and telecommunication technology.
A physical examination form may take place.
A non-medical technician may present in the Telehealth studio to aid in the video transmission.
Video, audio and/or photo recording may be taken of you during the procedure(s) or service(s).
Medical Information & Records: All existing laws regarding your success to medical information and copies of your medical record apply to this Telehealth consultation.
Please note not all telecommunications are recorded and stored. Additionally, dissemination of any patient identifiable images or information for this Telehealth interaction to any other parties or entities shall not occur without your consent.
Confidentiality: reasonable and appropriate effort have been made to eliminate any confidential risks associated with Telehealth consultation, and all existing confidentially protection under state and federal law apply to information disclosed during this Telehealth consultation.
Rights: you may withhold or withdraw your consent to the Telehealth consultation at any time without affecting your right to future care or treatment.
Disputes:
Risk, consequences and benefits: you have been advised of all the potential risks, consequences and benefits to Telehealth. Your health care provider has discussed with you the information provided above.
I agree to participate in the Game Time Physiotherapy Telehealth procedure(s) and/or service(s) above by signing the terms and conditions form.
NON-ASSIGNMENT OF RIGHTS
Your rights of whatever nature cannot be assigned nor transferred to anybody, and any such attempt may result in termination of this Agreement, without liability to us. However, we may assign this Agreement to any person at any time without notice.
NON-Waiver
Failure of the Game Time Physiotherapy to insist upon strict performance of any of the terms, conditions and covenants hereof shall not be deemed an relinquishment or waiver of any rights or remedy that we may have, or shall it be construed as a waiver of any subsequent breach of the terms, conditions or covenants hereof, which terms, conditions and covenants shall continue to be in full force and effect.
No waiver by either party of any breach of any provision hereof shall be deemed a waiver of any subsequent or prior breach of the same or any other provision.
Severability of Terms:
In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.
Entire Agreement:
This Agreement shall governed by and constructed in accordance with the substantive laws Australia, without any reference to conflict-of-law principles. The Agreement describes and encompasses the entire agreement between us and you, and supersedes all prior contemporaneous agreements, representations, warranties and understandings with respect to the Site, the contents and materials provided by or through the Site, and the subject matter of this Agreement.
Governing Law:
Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Australia, to exclusion of any court without giving effect to its conflict of law’s provisions or your actual state or country of residence.
